Over many decades, Congress has delegated much of their authority over to regulatory agencies, which are part of the Executive branch of government. And now Trump is using that fact to basically write new laws. Congress basically gave the Executive branch the power to do so by giving regulatory agencies the ability to create their own regulations.
This was incredibly shortsighted by Congress.
Congress can take their power back, but it leaves them in an awkward position. Trump is trying to destroy federal bureaucracy with his Executive Orders. But if Congress takes back the power to create regulations, that would destroy the federal bureaucracy's rule-making authority. Either way, Trump wins. Either way, the regulatory agencies lose the ability to write their own rules.
Like the man or hate the man, but that was bloody brilliant.
